By accessing and using the Services, you are agreeing to be contractually bound by these Terms. If you do not agree to these Terms, then do not access or use the Services. For any reason and at any time, The Fluent World may modify, amend or supplement these Terms or terminate your access to or use of the Services. Should these Terms be modified, amended, or supplemented, then your continued access or use of the Services as of the date these Terms are last updated constitutes your consent to be bound by the modified, amended, or supplemented Terms.
The Fluent World provides coaching, mentorship, entrepreneurial development services, and community support for Educators (including, but not limited to, teachers, instructors, independent contractors, and content providers) who are building and growing their own direct-to-consumer teaching businesses. The Services include access to: (a) private and group coaching sessions; (b) business development resources and training; (c) a community network for growth and accountability; and (d) The Fluent World digital platform as one of the available tools for course delivery.
A Client or Practitioner or Participant or Member or Follower, or Student or Entity (collectively, "User" or "Client") may participate in an activity, including, but not limited to, mentorship sessions, strategy workshops, virtual classrooms, events, and training provided in-person, online, or pre-recorded by The Fluent World or its associated Coaches, Mentors, or its owners, managers, employees, agents (collectively "The Fluent World").
The Fluent World platform (where applicable) provides a tool that facilitates connections between students and Instructors/Teachers (Third Party Providers) for educational services (Classes, Workshops, etc.). The Fluent World's primary focus, however, is on the success and entrepreneurial development of its Educator Clients through coaching and support. The platform tool, classes, and sessions offered by Third Party Providers are solely available for personal, non-commercial purposes. All Instructors are Third Party Providers who use The Fluent World platform as a tool to offer Instructions and other pieces of training.
For Educator Clients utilizing the platform tool to offer services, the Instructor understands that the relationship the Instructor has with The Fluent World by way of the Instructor’s access and use of the Services is that of an independent contractor at all times. This shall not be construed as creating any relationship, partnership, joint venture, employer-employee, agency, or franchisor-franchisee relationship in any way and/or of any kind between the parties hereto. Instructors are not employees of The Fluent World. Instructors do not have any entitlements, nor do they receive any benefits whatsoever. Instructors are responsible for their own personal and business taxes at all times and for their own profits and losses. Instructors expressly consent to carry and maintain professional liability Insurance and are responsible for all claims against the services and content offered.
Since The Fluent World is not a member of any governing or accreditation body and therefore cannot guarantee that the classes or series offered by you as an Instructor meets the standards developed by such governing bodies. The Fluent World does not make you eligible for certification by any governing or accreditation body to teach any subject matter or educational content. You agree not to hold yourself out as a certified language or subject instructor based on completing the courses, content, or programs available on the Service or use The Fluent World’s name as a certification or accreditation body for purposes of teaching and related services. Further, you expressly waive and release The Fluent World and its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates, and representatives of any claim arising from or in connection with teaching or business services or a violation of the terms as provided herein.
So long as your access and use of the Services comply with these Terms, The Fluent World grants you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to access and use the Applications and their contents on your personal device. Instructors retain ownership of their business materials, entrepreneurial content, and lesson content across all subjects. By utilizing The Fluent World’s coaching, community, or platform tool, instructors grant The Fluent World a license to use this content for promotional purposes. All rights not expressly granted herein are reserved by The Fluent World. You will not: (a) modify, copy or create any derivative works based on the Services; (b) reverse engineer or decompile any portion of the Services, including but not limited to, any software utilized by The Fluent World in the provision of the Services; (c) access or use (or allow a third party to access or use) the Services for competitive analysis or to build any competing products or services; (d) license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, or otherwise make the Services available to any third party, other than to yourself, (e) copy any functions, integrations, features, interfaces or graphics of the Services; or (f) otherwise use or exploit the Services in any manner not expressly permitted by these Terms of Use.
In order to use the Services, and for security and identity verification purposes, you must set up and maintain a personal account (Account) via login to Facebook or Google or an email account. In order to continue using the Services, you must maintain the same Facebook or Google account you used to set up your Account. Otherwise, you will be denied access to or use of the Services. You must be at least 18 years of age to obtain an Account. Persons under the age of 18 must have parental approval to create a Student Account (where applicable). The Fluent World will not be held liable for any unauthorized underage usage or content. Additionally, in order to complete a Services transaction, you must submit to The Fluent World certain personal information, such as your name, address, phone number, and photo. You may only possess one Personal Account. When you create an account, you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. You must provide true and accurate information about yourself and your country of residence when you create or update your Account. Providing us with false information may result in the termination of your Account.
With your permission, we may give other websites or services the ability to verify information about your Account or perform actions on your behalf. This permission is asked for when you connect your Account to these other websites or services.
If you become a Client of an Instructor through the platform tool, you agree to have the following information shared with that Instructor:
your name and email address, and other profile information you’ve provided
any messages you send providers through The Fluent World
your physical address, city, state, and country
your phone number for event notifications via text
all information about payment transactions, but not your full payment card information
As an Educator Client using the platform tool for course delivery, you will need to set up a Stripe payment account through the Services, via the Stripe API, in order to get paid for your services. As a Student Client using the platform tool, you will make payment thru the Services via a valid credit card you enter into Stripe, via the Stripe API, in order to book group classes or sessions on The Fluent World or purchase access to content. You agree to maintain accurate, complete, and up-to-date information in your Account. Failure to do so may result in your inability to access and use the Services, or The Fluent World’s termination of this Agreement with you. You are responsible for all activity that occurs under your Account, and you agree to maintain the security of your Account at all times.
We can terminate or suspend your Account at any time at our discretion without cause. We can also remove any descriptions, posts, or benefits at our discretion without reimbursement for the remaining billing period. You may not bring a claim against us for suspending or terminating another person’s account, and you agree you will not bring such a claim. If you try to bring such a claim, you are responsible for the damages caused, including attorney’s fees and costs. These terms remain in effect even if you no longer have an account.
Persons under the age of 18 who use the Services MUST be supervised by parents or guardians. You agree to comply with all applicable laws when using the Services, and you may only use the Services for lawful purposes. Your use of the Services must not cause nuisance, annoyance, inconvenience, or property damage to any person or third party whatsoever. You may not authorize third parties to use your Account. You may not assign or otherwise transfer your Account to any other person or entity.
The Services and all rights therein are and remain the property of The Fluent World or its licensors. You are not granted or conveyed any rights by way of these Terms or by way of your use of the Services except for the limited license granted above. You may not otherwise use the Fluent World apps, The Fluent World website, the Fluent World brand, The Fluent World trademarks, The Fluent World copyright, or the trademarks of The Fluent World or its licensors.
The Services may be made available for access or use in connection with third-party services and content (including advertising) that The Fluent World does not control. Separate terms of use and privacy policies may apply to your use of such third-party services and content. Under no circumstances does The Fluent World endorse such third-party services and content. In no event shall The Fluent World be responsible or liable for any products or services of such third-party providers. If you access the Services using Applications developed for Apple iOS, Android, or Microsoft Windows-powered mobile devices, then you acknowledge that Apple Inc., Google, Inc., or Microsoft Corporation, respectively, will be a third-party beneficiary to this contract. These third-party beneficiaries are not responsible for the provision or support of the Services as they are not parties to this contract, although your access to the Services using these third-party beneficiary devices is subject to terms set forth in the applicable third-party beneficiary’s terms of service. You may grant The Fluent World access to your third-party accounts, such as Google, YouTube, Facebook, Instagram, Twitter, and Twitch, in order for some of The Fluent World's features to operate. Each time you connect your third-party account, that third-party account will present a page that describes the information that The Fluent World can access. At any time, you can revoke The Fluent World’s access to those accounts using the respective third party’s security settings page.
You may not: (i) transfer, transmit, stream, sell, resell, distribute, reproduce, lease, license, modify, broadcast, create derivative works based upon, publicly perform, publicly display, or otherwise exploit the Services except as expressly permitted by The Fluent World; (ii) remove any trademark, copyright or other proprietary identifiers from any portion of the Services; (iii) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks; (iv) disassemble, decompile, or reverse engineer the Services; (v) link to, frame or mirror any portion of the Services; (vi) cause or launch any scripts or programs in order to survey, scrape, index, or otherwise data mine any portion of the Services; or (vii) cause or launch any scripts or programs for purposes of burdening or hindering the operation and/or functionality of the Services.
All content must not violate our policies. We do not allow any content that:
is illegal
violates copyrights, uses others' intellectual property (unless you have written permission to use it)
is biased, discriminative, or abusive towards other people.
has real people engaging in unlawful, violent, sexual acts.
involve raffles or prizes based on chance.
originates from sanctioned areas and certain geographic locations
We proactively look at some content on The Fluent World to make sure Educator Clients and providers adhere to these standards. We also investigate reports of potential violations. These investigations may take a while to resolve and may include looking at what is supported by the earnings received by providers.
In most situations, we will work with providers and Educator Clients to resolve any potential violations and allow the provider to continue using The Fluent World. Please let us know if you see potential violations of our Terms and Conditions, and report them.
We must comply with the economic sanctions and trade restrictions of all of the countries we operate in. The Fluent World currently focuses on serving Educator Clients and Users within the United States. Access to the platform from outside the U.S. may be subject to additional restrictions. These restrictions generally prohibit transactions involving:
Certain geographic areas, such as Crimea, Cuba, Iran, North Korea, and Syria, or any individual or entity operating or residing in those places;
Individuals or entities identified on sanctions lists such as OFAC’s Specially Designated Nationals (“SDN”) List or Foreign Sanctions Evaders (“FSE”) List.
In order to protect our community, we take steps to ensure compliance with these regulations including, but not limited to:
We prohibit access to Services while in certain geographic locations.
Instructors and Content Providers are generally not allowed to offer benefits that originate from sanctioned areas.
We may request additional information from you, or ask you to take other steps to help us meet compliance obligations.
If we have reason to believe you are operating your account from a sanctioned location, such as any of the places listed above, or are otherwise in violation of any economic sanction or trade restriction, we may suspend, terminate or take other action on your account.
You are also prohibited from using The Fluent World for the benefit of any organization, entity, or person identified on a sanctions list.
You must obtain the data network access necessary to use the Services. If you access or use the Services from a wireless-enabled device, be aware that data and messaging rates and fees from your mobile network may apply. To access and use the Services and Applications and any updates to them, you are responsible for acquiring and updating compatible hardware and devices. The Services are not guaranteed to function on any particular hardware or devices. Additionally, malfunctions and delays inherent in the use of the Internet and electronic communications may affect the Services.
You must not provide User Content that is unlawful, hateful, violent, defamatory, libellous, obscene, pornographic, or otherwise offensive, as determined by The Fluent World, in its sole discretion, regardless of whether such material is protected by law. You acknowledge that The Fluent World may, at its discretion, monitor, review, or remove User Content, at any time and for any reason, without notice to you.
You represent and warrant that either all User Content is solely and exclusively yours, or that you have all requisite rights, licenses, consents, and releases to grant The Fluent World the license to the User Content. You also represent and warrant that the User Content and your uploading, publishing and otherwise making available such User Content, including The Fluent World’s use of the User Content as permitted herein, will not violate, infringe, or misappropriate a third party’s intellectual property or proprietary rights, or rights of privacy or publicity, or violate any applicable law or regulation.
Educator Clients may upload, publish and make available through the Services textual and visual content and information related to their business plans, coaching programs, entrepreneurial resources, and teaching services. Users may publish and make available through the Services textual reviews and ratings of those Instructors whose services Users booked through the Services. Users may use the Services to provide feedback to The Fluent World related to the Services and to initiate support requests. You keep complete ownership of all content you create, but you give us permission to use them on Services as part of The Fluent World. Make sure you have permission to use the content that you offer on The Fluent World as Services.
By providing User Content through the Services, you give The Fluent World a perpetual, irrevocable, transferable, worldwide, royalty-free license, with the right to sublicense, use, modify, copy, distribute, create derivative works of, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including, but not limited to, in connection with the Services and The Fluent World’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.. The purpose of this license is strictly limited to allow us to provide and promote memberships or one-time pay-per-view options to your followers or to promote the success of our Educator Clients. You may not post creations that infringe others' intellectual property or proprietary rights. Members and clients may not use creations posted by providers in any way not authorized by the provider. You can’t create fake content or collect money for things you’re not actually doing. You cannot pretend to be or impersonate someone else by using the name, brand, or works of another to deceive members.
Online or virtual coaching and training sessions are interactive in real-time with The Fluent World Mentors/Coaches or Third-Party Instructors. These Sessions are recorded where only the Instructor or Mentor may be visible and provide instruction or cues. If private sessions are recorded, they will be used in developing training plans ("Recordings"). Mentors/Coaches may only use the private session Recordings they conducted for teaching training and improvement, and for developing future Session planning with you. Mentors/Coaches may not disclose or use the Recordings for any other purpose. Recordings may be used by instructors and Mentors to review and improve their teaching methods or coaching techniques and to develop tailored lesson plans or business plans for their students.
In addition, our internal staff may view Recordings for review relating to the quality of the Training and Coaching, and for customer service and support, and for the development of Teacher or Instructor training, but actual clips of the recordings would not be shown to other Instructors in connection with such training without your permission. If you do not want an Instructor or Mentor to view your Training Session recording or want us to delete your Training Session recording, please contact us at info@thefluentworld.com
You expressly consent to be recorded in connection with the private Sessions that you participate in through the Services.
As of the date stated above, creating and maintaining a profile on The Fluent World is free for Users, but we reserve the right to implement fees for the Service at any time by providing you notice. Please note that while the use of the platform is free, a processing fee is charged on every transaction.
For all direct services provided by The Fluent World (e.g., coaching, membership to the entrepreneur community, resources): Full payment will be charged to your credit card upon booking a coaching session or purchasing any products or memberships. Charges will be inclusive of applicable taxes where required by law. Subscriptions will be automatically renewed unless auto-renew is turned off at least 24 hours prior to the end of the current subscription period. The Fluent World may suspend or terminate an Account and/or limit access to our Services if payment is late and/or payment cannot be processed.
For transactions with Third Party Instructors via the platform tool: As a Client, you understand that your completion of a transaction using the Services will result in charges to you for the services you receive from your selected Instructor ("Charges"). The Fluent World charges a processing fee on all transactions. When a transaction is made, a processing fee of 5% plus $1.85 is added to the transaction for the student to pay to cover payment processing and taxes. Booked classes and sessions can be canceled free of charge more than 12 hours in advance of the session start time. Any cancellations within 12 hours of the session are subject to the refund policy outlined below.
The fee schedule is subject to change at the Instructor’s sole discretion. Changes in fees will not affect class packages or sessions that have already been paid for and booked. From time to time, The Fluent World may offer free introductory sessions to new Clients on a promotional basis.
Our policy is No Refunds, though we allow for some exceptions as described below.
As of the date stated above, The Fluent World offers a single, mandatory Membership to access its coaching program, private community, live sessions, and the platform tool for course delivery.
Membership Fees and Renewal:
A one-time setup fee of $249 is charged upon initial enrollment in the Membership and coaching program.
The membership automatically renews on a monthly basis at $19.95 until canceled by the Educator Client.
The Fluent World reserves the right to modify membership fees and will provide notice of any such changes in advance.
Consequences of Cancellation: Should an Educator Client cancel their Membership subscription, they will immediately lose access to the following Services:
The Fluent World digital platform (for course delivery).
The private teachers community and networking channels.
All live coaching calls, mentorship sessions, and proprietary material.
Platform Transactions (for services rendered via the platform tool): Educator Clients using the platform tool for course delivery are not subject to the 5% platform transaction fee, as this fee is covered by the Membership. All Instructors must connect a valid Stripe account to receive payments for sessions, classes, packages, or digital products sold through the platform.
Future Fee Adjustments: The Fluent World reserves the right to implement an additional transaction processing fee onto all client transactions with Third Party Instructors (whether free or paid plans) in the future, should the need arise due to changes in operating costs or third-party processor rates. The Fluent World will provide notice of any such changes in advance.
Instructor Responsibilities: Instructors are independent providers responsible for compliance with local laws, including taxation, business licensing, and educational certifications where applicable. Instructors may not solicit or process off-platform payments or direct students to external platforms without written approval from The Fluent World. Violating this policy may result in immediate suspension or termination from the platform.
Some of the Content requires you to pay a fee, the details of which are available in various areas of the Site. You agree to pay all fees and applicable taxes incurred by you or anyone using your Account or your User Information. Certain content, classes, sessions, VoD, etc offered through the Service is available to you for a fee ("Paid Content"). The Fluent World uses a third-party payment processor (the "Payment Processor") to link your credit card account to the Service. The processing of payments or credits, as applicable, in connection with your use of the Service will be subject to the terms, conditions, and privacy policies of the Payment Processor and your credit card issuer in addition to these Terms. The Fluent World is not responsible for any errors by the Payment Processor. In connection with your use of the Service, The Fluent World will obtain certain transaction details, which The Fluent World will use solely in accordance with its Privacy Policy.
We may revise the pricing for products, services, or features offered through the Site at any time. Unless otherwise noted, all currency references are in U.S. dollars. All fees and charges are payable in accordance with payment terms in effect at the time the fee or the charge becomes payable. If there is a dispute regarding payment of fees to or products or Services provided by us, your Account may be closed and your User Information may be disabled without warning or notice at our sole discretion.
YOU ACKNOWLEDGE AND AGREE THAT ANY APPLICABLE FEES AND OTHER CHARGES FOR FEE-BASED PRODUCTS, SERVICES, OR FEATURES ARE NOT REFUNDABLE IN WHOLE OR IN PART AT THE SOLE DISCRETION OF THE FLUENT WORLD.
We may, from time to time, modify, amend, or supplement our fees and fee-billing methods, and such changes shall be effective immediately upon posting in these Terms or elsewhere on the Site.
If a private session or class is canceled by the Instructor:
100% of the session fee will be refunded to the Client, regardless of when the cancellation occurs.
If the Instructor cancels within 1 hour of the scheduled start time, the Instructor will be charged a 10% processing fee as a late cancellation penalty.
The Fluent World does not search for or assign replacement instructors in the event of cancellation. Clients may rebook with another instructor manually at their discretion.
If a private session or class is canceled by the Client:
More than 12 hours before the session start time: Client receives a 100% refund.
Less than 12 hours but more than 1 hour before the session start time: Client receives a 50% refund; the remaining 50% is retained as a cancellation fee.
Less than 1 hour before the session start time: No refund will be issued.
All direct coaching and mentorship fees (e.g., membership fees, pre-paid coaching packages) are non-refundable, except as expressly stated otherwise in the purchase agreement or as required by law.
Rescheduling: Clients must provide at least 24 hours' notice to reschedule a booked 1-on-1 coaching session with The Fluent World. Failure to provide 24 hours' notice will result in forfeiture of the session fee.
Users understand that gratuities (tips, donations) are strictly voluntary and not part of the Services. As a Client, you are under no obligation to pay gratuities as part of the Services. Clients who have booked services through the Services will have the opportunity to rate and review Instructors and donate or tip Instructors without any obligation.
As a User, you agree to indemnify and hold The Fluent World and its officers, directors, managing members, members, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees), arising out of or in connection with: (i) your use of the Services; (ii) The Fluent World’s use of your User Content; (iii) your breach or violation of any of these Terms; or (iv) your violation of the rights of any third party, including Third-Party Providers.
As a company based in the United States with operations in other countries, we must comply with economic sanctions and trade restrictions, including those implemented by the Office of Foreign Assets Control ("OFAC") of the U.S. Department of the Treasury. This means that The Fluent World cannot take part in transactions that involve designated people, places, or items that originate from those places, as determined by agencies like OFAC.
The Service may include tools that enable users to arrange in-person meetings. The Fluent World is not involved in arranging or supervising meetings and has no control over who attends meetings or what occurs at them, whether they relate to Third-Party Instructor services or Educator Client business collaborations. You agree that your use of the Service is at your own risk. You are solely responsible for taking all necessary precautions when interacting with other users, both online and offline.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." THE FLUENT WORLD DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN ADDITION, THE FLUENT WORLD MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, OR AVAILABILITY OF THE SERVICES OR ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE USE OF THE SERVICES, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. THE FLUENT WORLD DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY, OR ABILITY OF THIRD-PARTY PROVIDERS (INCLUDING INSTRUCTORS), OR THE SUCCESS OF ANY EDUCATOR CLIENT'S BUSINESS OUTCOME OR REVENUE GENERATION. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICES, AND ANY SERVICE OR PRODUCT REQUESTED IN CONNECTION THEREWITH, REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
THE FLUENT WORLD SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, REGARDLESS OF THE NEGLIGENCE (EITHER ACTIVE, AFFIRMATIVE, SOLE, OR CONCURRENT) OF THE FLUENT WORLD, EVEN IF THE FLUENT WORLD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE FLUENT WORLD SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY, OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY THIRD-PARTY PROVIDER (INCLUDING INSTRUCTORS) OR OTHER EDUCATOR CLIENTS, EVEN IF THE FLUENT WORLD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FLUENT WORLD SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND THE FLUENT WORLD’S REASONABLE CONTROL.
THE LIMITATIONS AND DISCLAIMER IN THIS SECTION DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS,
YOU ACKNOWLEDGE AND AGREE THAT THE FLUENT WORLD IS NOT LIABLE FOR ANY LOSS, DAMAGES, OR LIABILITY ARISING FROM THE FRAUDULENT, DECEPTIVE, OR UNLAWFUL ACTS OF ANY THIRD PARTY, INCLUDING SCAMS, IMPERSONATION ATTEMPTS, OR MISREPRESENTATION, EVEN IF SUCH ACTS ORIGINATE OR ARE ADVERTISED THROUGH THE SERVICES. YOU AGREE TO EXERCISE DUE DILIGENCE WHEN ENGAGING IN ANY FINANCIAL TRANSACTION OR PERSONAL INTERACTION.
Governing Law: These Terms are governed by and construed in accordance with the laws of Nevada, U.S.A., without regard to its conflict of law provisions.
Agreement to Arbitrate: You agree that any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Services (collectively, "Disputes") will be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights.
Waiver of Jury Trial: YOU ACKNOWLEDGE AND AGREE THAT YOU AND THE FLUENT WORLD ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTERIAL IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. FURTHER, UNLESS BOTH YOU AND THE FLUENT WORLD OTHERWISE AGREE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS, AND MAY NOT OTH
